Volunteer Release Agreement
ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
Assumption of Risk
The undersigned hereby acknowledges and agrees that they understand the nature of the Event; that Participant is qualified, in good health, and in proper physical condition to participate in the Event; and that there are certain inherent risks and dangers associated with the Event. Except as expressly set forth herein, the undersigned knowingly and voluntarily accepts and assumes responsibility for each of these risks and dangers, as well as all other risks and dangers that could arise out of or occur during Participant’s participation in the Event.
Release and Waiver
The undersigned hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the St. Louis Sports Commission, St. Louis Sports Foundation, National Sportsmanship Foundation, and each of their respective officers and employees (collectively, the “Releasees”), from and against any and all liability resulting from any personal injury, accident, or illness (including death), and/or property loss, however caused, arising out of or in any way related to Participant’s participation in the Event, except to the extent caused by the willful misconduct, gross negligence, or intentional torts of the above parties, as applicable.
Indemnification and Hold Harmless
The undersigned further agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releasees from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including, but not limited to, attorneys’ fees, arising out of or in any way related to Participant’s participation in the Event, except to the extent arising from the willful misconduct, gross negligence, or intentional torts of the above parties, as applicable.
Permission to Use Likeness/Name
The undersigned further agrees to allow, without compensation, Participant’s likeness and/or name to appear in, and otherwise be used in, materials, regardless of media form, promoting the Event and/or related events and activities, including those of its representatives and licensees.
Severability
The undersigned expressly agrees that the foregoing assumption of risk, release and waiver of liability, and indemnification agreement is intended to be as broad and inclusive as permitted by the laws of the State of Missouri. If any portion thereof is held invalid or unenforceable, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding
The undersigned acknowledges that they have read this assumption of risk, release and waiver of liability, and indemnification agreement and have had the opportunity to ask questions about the same. The undersigned fully understands this assumption of risk, release and waiver of liability, and indemnification agreement, that they are giving up substantial rights in connection therewith, and that its terms are contractual and not a mere recital. The undersigned acknowledges that they are signing this agreement freely and voluntarily.

MINOR PARTICIPANT ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
Assumption of Risk
The undersigned parent or legal guardian of the above-named minor Participant (“Participant”) hereby acknowledges and agrees that they understand the nature of the Event; that, to the best of their knowledge, Participant is qualified, in good health, and in proper physical condition to participate in the Event; and that there are certain inherent risks and dangers associated with the Event.
The undersigned parent or legal guardian, on behalf of themselves and Participant, knowingly and voluntarily accepts and assumes responsibility for each of these risks and dangers, as well as all other risks and dangers that could arise out of or occur during Participant’s participation in the Event.
Release and Waiver
The undersigned parent or legal guardian, on behalf of themselves and Participant, hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the St. Louis Sports Commission, St. Louis Sports Foundation, National Sportsmanship Foundation, and each of their respective officers and employees (collectively, the “Releasees”), from and against any and all liability resulting from any personal injury, accident, or illness (including death), and/or property loss, however caused, arising out of or in any way related to Participant’s participation in the Event, except to the extent caused by the willful misconduct, gross negligence, or intentional torts of the above parties, as applicable.
The undersigned parent or legal guardian further agrees that this release and waiver is intended to apply to claims brought by or on behalf of Participant, to the fullest extent permitted by applicable law.
Indemnification and Hold Harmless
The undersigned parent or legal guardian further agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releasees from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including, but not limited to, attorneys’ fees, arising out of or in any way related to Participant’s participation in the Event, except to the extent arising from the willful misconduct, gross negligence, or intentional torts of the above parties, as applicable.
To the extent permitted by applicable law, the undersigned parent or legal guardian agrees that this indemnification obligation includes claims made by or on behalf of Participant.

The undersigned parent or legal guardian hereby grants permission, on behalf of Participant, to allow, without compensation, Participant’s likeness and/or name to appear in, and otherwise be used in, materials, regardless of media form, promoting the Event and/or related events and activities, including those of its representatives and licensees.

The undersigned expressly agrees that the foregoing assumption of risk, release and waiver of liability, and indemnification agreement is intended to be as broad and inclusive as permitted by the laws of the State of Missouri. If any portion thereof is held invalid or unenforceable, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding
The undersigned parent or legal guardian acknowledges that they have read this assumption of risk, release and waiver of liability, and indemnification agreement and have had the opportunity to ask questions about the same.
The undersigned parent or legal guardian fully understands this assumption of risk, release and waiver of liability, and indemnification agreement, understands that they are giving up substantial rights in connection therewith, and understands that its terms are contractual and not a mere recital.
The undersigned parent or legal guardian acknowledges that they are signing this agreement freely and voluntarily and that they are authorized to provide consent and enter into this agreement on behalf of the minor Participant.
By signing below, the undersigned represents that they are the parent or legal guardian of the Participant identified above and that they have the authority to execute this agreement on Participant’s behalf.
